Know Your Rights
According to gov.uk – “You’re an agency worker if you have a contract with an agency but you work temporarily for a hirer. Agencies can include recruitment agencies, for example ‘temp agencies’.”
As an agency worker you have certain rights. These rights are designed to protect you from unfair treatment.
- The right to rest breaks and annual leave
- The right to a safe working environment
- The right to be treated fairly
- The right to National Living Wage
Gov.uk gives the following advice – “Recruitment agencies cannot charge you a fee for finding or trying to find you work.
They can charge you for certain services, for example CV writing, training or transport. You have the right to cancel these as long as you give notice.”
Temp Zone - Pay And Benefits
As a temporary worker in the UK, your pay and benefits can vary depending on a range of factors, such as your experience, the industry, the assignment, and the specific terms of your contract.

Basic Pay
Your basic pay will depend on the type of work you are doing, as well as your level of experience and qualifications.
The compensation for each assignment will be clearly specified on your shift confirmation.
Basic pay is always above the National Living Wage.
Holiday Pay
Holiday pay is based upon your last twelve weeks pay (not 12 calendar weeks). We add up the total number of normal hours you have worked within the last 12 paid weeks and we add up the amount of gross pay you have been paid.
Please remember that bonus payments and ad-hoc overtime do not form part of the calculation unless the overtime is guaranteed to be offered and you are expected to work it.
Only hours that form part of your ‘normal working week’ and are included in the calculation.
Statutory Sick Pay
You will be eligible for Statutory Sick Pay if you meet the relevant statutory criteria. If you’re eligible, you’ll be paid SSP for all the days you’re off sick that you normally would have worked, except for the first 3.
You will be required to provide Goldstar with evidence of incapacity to work which may be by way of a self-certificate for the first 7 days of incapacity and a doctor’s certificate thereafter.
For the purposes of the Statutory Sick Pay scheme there is one qualifying day per week during an assignment and that qualifying day shall be the Wednesday in every week.
Pension
To help people save more for their retirement, all employers are required by law to provide a workplace pension scheme for certain staff and pay money into it.
Therefore, you will be enrolled into our pension scheme with the pension company on your first qualifying pay period because you met all the following criteria:
- You earn over £192 per week (or £833 per month)
- You are aged 22 or over
- You are under state pension age
You can opt out of the pension scheme if you want to, but if you stay in you will have your own personal pension when you retire. Your pension will belong to you, even if you leave us in the future.
Both you and us will pay contributions into it every pay period, and the government will also contribute through tax relief.
You will also receive a starter pack of information from the pension scheme which will tell you everything you need to know about automatic enrolment.
Referral bonus
You must be a registered candidate of Goldstar Recruitment and must have completed certain number of hours in a temporary assignment to be eligible for bonus.
One person can refer multiple people and receive multiple rewards as long as the terms are followed accordingly.

Your Employment Status
It is important to understand your employment status as a temporary worker because your status will affect your rights and responsibilities, as well as your pay and benefits.

IR35 Legislation
As a freelancer you will need to obtain work through PAYE from April 2021 as opposed to through a Limited Company. Using an agency to obtain Relief Chef work means you will be treated as an employee for tax purposes, income tax and national insurance will be deducted at source. This is the best way for you to ensure that you are compliant and protected.
The Do's and Don'ts of Temping
Do
- Be clear and honest about your availability with your recruiter.
- Be reliable and realistic.
- Read your shift confirmation.
- Ensure you leave enough travel time to arrive before your shift starts.
- Advise us as soon as possible if you can’t attend your shift.
- Address any issues, concerns, or problems as soon as possible.
Don't
- Book shifts that you can’t attend due to other appointments or location.
- Accept work that you don’t have the required skills or uniform for.
- Use your mobile phone on shift.
- Forget that your contract is with the agency, not with the client.
- Forget to get your timesheet signed and send it before the deadline.
- Use one timesheet for multiple workplaces.
